RE: The tariff classification of Mosapride Citrate Dihydrate (CAS-156925-25-6) in bulk form, from India

Dear Ms. Donnelly:

In your letter dated August 10, 2010, you requested a tariff classification ruling.

The subject product, Mosapride Citrate Dihydrate, is a selective 5-HT4 receptor agonist. Currently, it is in Phase IV clinical studies for the treatment of Gastroesophageal Reflux Disease (GERD).

The applicable subheading for Mosapride Citrate Dihydrate in bulk form will be 2934.99.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Nucleic acids and their salts, whether or not chemically defined; other heterocyclic compounds (con.): Other: Other: Aromatic or modified aromatic: Other: Drugs.” Pursuant to General Note 13, HTSUS, the rate of duty will be free.
